Program Terms & Conditions
Introduction
This document provides the terms and conditions for PIC's Guest Loyalty Program
(the "GLP"). Participation in the GLP is strictly subject to these terms and
conditions, which may be changed at any time by PIC, at its discretion, with or
without notice. It is the responsibility of all GLP members to read and
understand these terms and conditions in their entirety. In general, there are
two ways to participate in the GLP. If you make your room reservation directly
with PIC, pay an eligible room rate, and meet other requirements, you will be
entitled to become a "Diamond Card" member. For each subsequent visit to a PIC
resort for which you make your room reservation directly with PIC, pay an
eligible rate, and meet other requirements, you will receive Diamond Card member
benefits. If, on the other hand, you make your room reservation through a tour
operator or travel agent, pay an eligible rate, and meet other requirements, you
will be entitled to become a "Sapphire Card" member. For each subsequent visit
to PIC for which you make your room reservation through a tour operator or
travel agent, pay an eligible rate, and meet other requirements, you will
receive Sapphire Card member benefits.
General Membership
1. Both PIC Guam and PIC Saipan Resorts (collectively referred to as "PIC" in
these terms and conditions) are participants in the GLP. This means, for
example, that a person who has obtained a GLP membership and a Diamond Card
through a stay at PIC Guam may obtain Diamond Card benefits through a qualifying
stay at PIC Saipan, and vice versa.
2. GLP membership and GLP benefits are offered at the sole discretion of PIC.
PIC has the absolute right to change or cancel the GLP, these terms and
conditions, and all other GLP rules and regulations (these terms and conditions
and all other GLP rules and regulations are referred to hereinafter as the
"Rules") at any time, with or without notice. This is true although any such
change or cancellation may reduce the value of benefits or eliminate the
benefits entirely. PIC may, by way of example and not limitation: (a) increase,
decrease, or eliminate what GLP members receive for qualifying stays at PIC; (b)
increase or decrease the amount which must be paid for a room rate to be deemed
an "eligible" rate, or "Sapphire Card eligible" rate, both as defined below; (c)
cancel the GLP. Neither being accepted as a GLP member, nor receiving a Diamond
Card, nor receiving a Sapphire Card, creates any entitlement or vested rights
with respect to GLP benefits or anything else of value.
3. PIC may amend the Rules at any time, with or without notice. PIC has the sole
discretion to interpret and apply the Rules.
4. Each GLP member is responsible for staying current on the Rules by reading
these terms and conditions, as they may be modified, and newsletters and other
statements, if any, in order to understand the member's rights, if any,
responsibilities, and status in the GLP.
5. Neither GLP membership, nor GLP benefits, are transferable.
6. After applying to become a GLP member, a qualifying applicant will be given a
GLP membership number. After receiving this membership number, a GLP member may
seek to meet the requirements for either the Diamond or Sapphire membership
levels pursuant to the Rules.
7. Only individual, natural persons are eligible for the GLP. An individual may
only become a member by personally meeting the requirements of membership. (By
way of example and not limitation, no individual may complete an application on
behalf of another individual.) Each individual may maintain only one membership.
Any duplicate membership will be canceled.
8. If a member is traveling for business purposes, it is each such member's
responsibility to comply with his or her company's policies regarding programs
such as the GLP.
9. GLP membership benefits are available only to a GLP member who pays PIC the
entire cost of the stay, regardless of whether other guests staying in the room
are also GLP members.
10. A GLP member's membership and account may be de-activated in PIC's
discretion if the member has had no qualifying stays with PIC within a 24 month
period. A GLP member may re-activate his or her account by staying at PIC, so
long as such member pays an eligible rate as determined by PIC.
11. Any member who does not stay at PIC at least one night during any 24 month
period may be removed from all participation in the GLP and such membership may
be closed. In such event, the GLP member is subject to having any and all
accumulated rights and privileges forfeited.
12. In the event PIC decides to terminate the GLP, notice will be provided via
the Internet at www.pacificislandsclub.com 90 days in advance of the GLP
termination date.
13. Participation in the GLP may result in tax liability for members. Any and
all tax liability arising under or relating in any way to a member's
participation in the GLP is the sole responsibility of the member.
14. In the event of fraud or dishonesty involving the GLP and/or GLP membership,
PIC shall have the right to take any legal action it deems appropriate and the
membership shall be subject to cancellation.
15. Membership in the GLP, and any and all rights and benefits of membership
that a member may have, may be canceled at PIC's sole discretion in the event a
member fails to pay PIC any sums due when such sums or due or otherwise fails to
fully honor any financial obligation to PIC.
16. All GLP benefits must be used, if at all, during the stay for which they
have been issued. That is, the GLP benefits may not be retained for use during
future stays.
17. GLP membership and benefits are void where prohibited by law.
18. The GLP, these terms and conditions, and all additional Rules shall be
governed by and construed under the laws of the Commonwealth of the Northern
Mariana Islands, United States of America (the "CNMI") and any dispute arising
under or relating to the same shall be resolved in the courts of the CNMI
whether or not any litigant is presently or hereafter becomes a resident of
another jurisdiction.
19. The GLP shall take effect on April 1, 2004.
20. Former WBP members must present themselves at the concierge or front desk
and convert their WBP membership to GLP membership by completing a new
application form. A gift will be remitted to each person who converts his or her
WBP membership.
Diamond Membership and Benefits
Eligibility for Membership
1. To qualify for Diamond Card membership, an individual must reserve directly
with PIC ("directly" means through PIC's website, e-mail, sales offices, or
resort), pay an eligible rate ("eligible" rates include published rates, PIC
e-Packages, PIC Web Packages, and Direct Hotel Bookings), complete the GLP
application, and provide the temporary membership number to PIC.
2. If an individual already has a Sapphire Card membership, he or she may obtain
a Diamond Card membership by reserving a stay directly with PIC, providing the
Sapphire membership number at the time of reservation, paying an eligible rate,
presenting the member's Sapphire Card at check in, and requesting a Diamond Card
at check in.
3. For all stays after an individual has become a Diamond Card member, such
member is eligible to receive Diamond Card benefits. In order to qualify for
Diamond Card benefits during a stay, a Diamond Card member must reserve directly
with PIC, provide the member's Diamond membership number at the time of
reservation, pay an eligible rate, and present the member's Diamond Card at
check in.
4. For all stays after an individual has become a Diamond Card member for which
the member does not qualify for Diamond Card benefits, either because the member
did not reserve directly with PIC or did not pay an eligible rate, such member
is eligible to receive Sapphire Card Benefits. In order to qualify for Sapphire
Card benefits during a stay, a Diamond Card member must reserve through a tour
or travel agent, pay a "Sapphire Card eligible rate" (as defined below), and
present the member's Diamond Card at check in.
Benefits
For all stays after an individual has become a Diamond Card member and for which
the member has reserved directly with PIC, provided the member's Diamond
membership number at the time of reservation, paid an eligible rate, and
presented the member's Diamond Card at check in, such member will be eligible to
receive the following Diamond
Card benefits:

+ Complimentary Airport Transfers
+ Members Welcome Gift
+ Complimentary Drink Coupon
+ Extended Late Check-Out time, (subject to confirmation)
+ 10% Discount on all Food and Beverage Services
Sapphire Membership and Benefits
Eligibility for Membership
1. To qualify for Sapphire Card membership, an individual must reserve through a
tour or travel agent, pay a "Sapphire Card eligible rate" (a "Sapphire Card
eligible rate" is any rate paid through a tour or travel agent but does not
include special discounted rates such as Airline Crews, Military, Sales
Promotions, Complimentary, or Barter rates), complete the GLP application, and
provide the temporary membership number to PIC.
2. For all stays after an individual has become a Sapphire Card member, such
member is eligible to receive Sapphire Card benefits. In order to qualify for
Sapphire Card benefits during a stay, a Sapphire Card member must reserve
through a tour or travel agent, pay a Sapphire Card eligible rate, and present
the member's Sapphire Card at check in.
Benefits
For all stays after an individual has become a Sapphire Card member and for
which the member has reserved through a tour or travel agent, paid a Sapphire
Card eligible rate, and presented the member's Sapphire Card at check in, such
member will be eligible to receive the following Sapphire Card benefits:
+ Welcome Back Gift.
+ Complimentary drink coupon.
Membership Status
1. Each member is responsible for ensuring that the member's stays are properly
recorded by PIC and that the member has received the proper membership card
(Sapphire or Diamond).
2. Any errors or questions regarding membership status must be communicated to
the GLP manager at
